Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Dropnaut mobile application and website (the "Service") operated by Dropnaut ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, merchants, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. You represent that you are over the age of 13. The Service is not intended for children under 13.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
Dropnaut serves as a discovery platform and aggregator for products ("Drops"). We facilitate the discovery of items but are not a party to any transaction between buyers and sellers unless explicitly stated.
You agree not to engage in any of the following prohibited activities:
Swiping vertically (Up or Down), tapping "Interested", or interacting with a product card via the Dropnaut interface is a non-binding expression of interest. Users are never under a contractual obligation to purchase an item solely based on their interaction with the discovery feed.
Merchants and Brands listed on Dropnaut reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. The listing of a product does not constitute a binding offer to sell. In the event of pricing errors, stock shortages, or technical errors, Merchants are not required to fulfill orders.
The Service may contain links to third-party web sites or services that are not owned or controlled by Dropnaut. Dropnaut has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Dropnaut and its licensors. The Service is protected by copyright, trademark, and other laws.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.
Participation in the "Vanguard" program or any beta features is at our sole discretion. "Points", "Swipes", or "Status" earned within the app have no real-world cash value and can be modified or revoked by Dropnaut at any time without compensation.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DROPNAUT MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.
IN NO EVENT SHALL DROPNAUT, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
You agree to defend, indemnify and hold harmless Dropnaut and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
